1. Introduction

1.1. These Terms and Conditions govern your use of our mobile application, website, and related services through which consumers may browse, purchase, and receive food and beverage products. By accessing the platform, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, you must stop using the platform.

2.2. “User”, “you”, and “your” refer to any individual accessing or purchasing through the platform.

2.3. “Products” refer to all goods offered for sale through the platform.

2.4. “Order” refers to a purchase request submitted by a user.

3. Eligibility

4. Account Registration and Security

4.1. You must create an account to place orders. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Any unauthorized access must be reported to us immediately. We are not liable for losses arising from your failure to safeguard your account.

5. Orders and Pricing

5.1. All orders are subject to acceptance and product availability.

5.2. Prices are displayed in local currency and include applicable taxes unless stated otherwise.

5.3. We may update prices at any time; however, the price shown at checkout applies to your order.

5.4. Once an order is confirmed, cancellation may not be possible if the order has already been processed or dispatched.

6. Delivery

6.1. Order Confirmation: After placing an order, you will receive a confirmation with estimated delivery timelines.

6.2. Delivery Timelines: Estimated delivery dates are indicative and may vary due to factors beyond our control.

6.3. Delivery Requirements: You must provide a complete and accurate delivery address. If delivery fails due to incorrect information or unavailability of a recipient, delivery and/or redelivery fees may apply.

6.4. Split Deliveries: We may deliver items in separate shipments depending on availability.

6.5. Risk of Loss: Risk transfers to you upon physical delivery to your address.

6.6. Title: Ownership transfers only after full payment is received.

6.7. Delivery Fee: Delivery fees and minimum order values for free delivery are displayed on the platform and may vary based on location, order size, promotional campaigns, or operational considerations. These amounts are subject to change at any time without prior notice. The delivery fee applicable to your order will be shown at checkout before payment is completed. If your order does not meet the minimum value required for free delivery at the time of checkout, the standard delivery fee will apply. Delivery fees are non-refundable once the order has been dispatched, except where required by applicable law.

6.8. Delays & Liability: While we use commercially reasonable efforts to meet stated delivery times, we shall not be liable for delays caused by events outside our control. We are not required to take extraordinary or disruptive measures to mitigate such delays.

7. Product Quality, Inspection, and Returns

7.1. We ensure that Products meet quality and safety standards.

7.2. If you receive a defective, damaged, expired, or incorrect Product, you must notify us within twenty-four hours of delivery and provide supporting evidence such as photos or delivery notes.

7.3. If validated, we may replace the Product or issue a refund in the form of wallet credits at our discretion.

7.4. Failure to notify us within the specified period constitutes acceptance of the Products.

8. Refunds and Wallet Credits

8.1. Refunds are issued exclusively as digital wallet credits within 10 working days unless otherwise required by applicable law.

8.2. Wallet credits may be used for future purchases but cannot be withdrawn as cash.

8.3. Wallet credits may have an expiry date, which will be displayed in your account.

9. Payment Methods

9.1. We accept the payment methods displayed at checkout, which may include credit or debit cards, online payment gateways, or other approved methods.

9.2. Cash on delivery is not accepted unless explicitly stated at checkout.

10. User Responsibilities

10.1. You agree to use the Products in accordance with all applicable food safety, storage, and handling guidelines.

10.2. You may not misuse, tamper with, or repackage Products in a manner that violates safety standards or applicable laws.

11. Intellectual Property

11.1. All content on the platform, including images, logos, product descriptions, and trademarks, is owned by us or our licensors. You may not copy, reproduce, or use such content without written permission.

12. Prohibited Conduct

12.1. You may not:

12.1.1. use the platform for fraudulent or unlawful purposes

12.1.2. interfere with platform security or functionality

12.1.3. create multiple accounts to misuse promotions or benefits

12.1.4. engage in any activity that harms the platform, other users, or our business

12.2. We may suspend, restrict, or terminate your account at any time and without prior notice if we detect or reasonably suspect fraud, unauthorized activity, misuse of the platform, abuse of pricing or promotional offers, creation of multiple accounts for advantage, or any conduct that harms our business or other users. Any pending orders may be cancelled, and any benefits, credits, or promotions obtained through misuse may be revoked.

13. Third-Party Links

13.1. The platform may contain links to third-party websites or tools. We do not control or endorse these services and are not responsible for their content or policies. Your use of third-party services is at your own risk.

14. Disclaimer of Warranties

14.1. The platform and Products are provided on an “as is” and “as available” basis. Except as required by law, we make no warranties regarding uninterrupted service, accuracy of information, or suitability of Products for your specific needs.

15. Limitation of Liability

15.1. To the maximum extent permitted by law, our liability for any claim arising from your use of the platform or purchase of Products is limited to the value of the affected order.

15.2. We are not liable for indirect, incidental, or consequential damages, including loss of profits or data.

16. Force Majeure

16.1. We shall not be liable for any delay, failure to perform, or interruption of service caused by events or circumstances beyond our reasonable control. These events include, but are not limited to, acts of God, natural disasters, fire, flood, explosion, pandemic, epidemic, war, terrorism, civil unrest, government actions, or restrictions, embargoes, labor disputes, strikes, lockouts, power outages, telecommunications failures, transportation disruptions, supply chain interruptions, or any other event that could not reasonably have been foreseen or prevented.

16.2. If a Force Majeure event occurs, we may suspend, delay, or cancel affected orders or services without liability. Where possible, we will notify you of the nature of the event and any expected impact on your order. If the event continues for an extended period and prevents us from fulfilling your order, we may cancel the order and issue a refund in accordance with our refund policy.

16.3. Your obligations to pay for delivered Products or charges incurred prior to the Force Majeure event remain unaffected.

17. Indemnity

17.1. You agree to indemnify and hold us harmless from any claims, losses, or liabilities arising from your misuse of the platform or breach of these Terms.

18. Changes to Terms

18.1. We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

19.1. These Terms are governed by the laws of Dubai, United Arab Emirates in which the Company operates.

19.2. Any disputes shall be resolved through the competent courts of Dubai, UAE unless otherwise required by applicable consumer-protection laws.
